1. About Us & Agreement Terms

This website (medicalweightpharmacy.co.uk) is operated by Medical Weight Pharmacy (“we”, “us”, “our”). We are a registered UK distance-selling pharmacy regulated by the General Pharmaceutical Council (GPhC) and operating in compliance with the Medicines and Healthcare products Regulatory Agency (MHRA).

By accessing our website, registering an account, completing a medical assessment questionnaire, or requesting clinical consultation services, you (“the patient”, “you”) agree to be legally bound by these Terms & Conditions, our Privacy Policy, and our Delivery Policy.

2. Eligibility Requirements

To use our services and receive prescription weight management treatments, you must satisfy the following criteria:

• Be at least 18 years of age at the time of consultation.
• Be physically located and resident within the United Kingdom.
• Be purchasing treatment solely for your personal medical use (resale, distribution, or sharing medication with third parties is strictly prohibited by law).
• Possess a valid UK payment method registered in your own name.
• Maintain capacity to understand clinical advice and give informed consent.

3. Clinical Assessment & Patient Declarations

Weight management treatments offered through our platform involve Prescription-Only Medicines (POMs). By completing an online clinical questionnaire, you confirm and warrant that:

1. Truthful Declaration: All answers regarding your age, weight, height, medical history, concurrent conditions, allergies, and existing medications are truthful, accurate, and up to date.
2. No Multiple Requests: You are not simultaneously requesting weight loss treatments from other online pharmacies or prescribers without disclosing this in your consultation.
3. Self-Measurement: Weight and height measurements supplied are recent (taken within the last 7 days).
4. Medical Verification: You agree to provide photographic ID, scale photos, or identity verification documents if requested by our prescribers to confirm your clinical eligibility.
5. Reading Information: You will thoroughly read all medication leaflets, patient guides, and administration instructions provided with your dispensed medication before initiating treatment.

4. Prescribing Authority & Order Acceptance

Submitting an online questionnaire and making payment on our website constitutes an offer to contract for clinical assessment and potential prescription supply. It does not constitute a guaranteed contract of supply.

• Prescriber Discretion: A qualified UK prescriber (GPhC or GMC registered) independently reviews every consultation. The prescriber retains absolute discretion to refuse a prescription if they judge the requested treatment unsafe, inappropriate, or clinically unjustified.
• Refusal & Refund: If a prescriber declines your consultation based on medical grounds, your payment pre-authorisation will be released or refunded in full within 3 to 5 working days.
• Contract Formation: A binding contract for the supply of prescription medicine is only formed once our prescriber approves your prescription and the pharmacy issues a dispatch notification.

5. Pricing, Fees & Payments

All prices listed on our website are in British Pounds Sterling (£) and include relevant VAT (where applicable). Prices for prescription pathways include the cost of clinical consultation, prescriber evaluation, and pharmacy dispensing.

• Payment is required at the time of submitting your consultation request.
• We reserve the right to amend pricing at any time without prior notice. Price changes will not affect orders that have already been approved by a prescriber.
• Payment card details are securely handled by PCI-DSS compliant payment processing gateways. We do not store raw card numbers.

6. Cancellations, Refunds & Returns Policy

Due to the regulated nature of medicinal products under UK law, specific rules apply to cancellations and returns:

A. Prescription-Only Medicines (No Return Policy)

In accordance with the Human Medicines Regulations 2012 and GPhC guidance, medicinal products cannot be returned once dispatched from the pharmacy premises. Medicinal items returned by patients cannot be re-used or re-sold and must be safely destroyed.

B. Cancellation Before Prescriber Approval

If you wish to cancel your order before a prescriber has reviewed and approved your medical assessment, you may request a cancellation by contacting customer support immediately. If approved prior to prescription generation, a full refund will be processed.

C. Cancellation After Prescriber Approval

Once a prescriber has issued a prescription and the pharmacy team has initiated dispensing or dispatch preparation, orders cannot be cancelled or refunded.

D. Damaged or Faulty Items

If your order arrives damaged, leaking, compromised in cold-chain transit, or incorrect due to a dispensing error, you must notify us within 24 hours of delivery at whatsapp with photos of the damaged item and packaging for review and replacement.

7. Cold-Chain Delivery & Patient Responsibility

Many injectable weight management treatments require temperature-controlled storage between 2°C and 8°C during transit.

• We dispatch cold-chain items in thermal insulated packaging with ice packs designed to keep medication within the safe temperature range for up to 48 hours.
• Patient Receipt Duty: You are responsible for ensuring someone is available at your specified delivery address to accept delivery on the expected day.
• Immediate Refrigeration: You must unbox and place cold-chain items into a domestic refrigerator (2°C – 8°C) immediately upon receipt.
• Medical Weight Pharmacy accepts no liability for medication degraded due to customer failure to collect missed deliveries promptly from courier sorting offices.

8. GP Notification & Duty of Care

In accordance with Good Medical Practice standards, safe clinical care requires sharing information regarding prescription treatments with your registered NHS or private GP practice.

• During consultation, you will be asked to provide your GP practice details.
• We strongly recommend allowing us to notify your GP of treatment. If you choose to opt out of GP notification, you explicitly accept full responsibility for informing your healthcare providers of any weight loss treatment prescribed through our service.

9. Adverse Reactions & Medical Emergencies

If you experience unexpected or severe side effects, stop taking the medication and seek medical care immediately.

10. Limitation of Liability

To the maximum extent permitted by UK law:

• Medical Weight Pharmacy shall not be liable for any medical complications, adverse effects, or treatment failures resulting from incorrect, false, or misleading medical declarations provided by the patient.
• We do not guarantee specific weight loss outcomes, as treatment efficacy varies based on individual metabolic health, diet, lifestyle, and adherence to clinical advice.
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any statutory rights under the Consumer Rights Act 2015 that cannot be legally excluded.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
